CERTIFICATE OF AUTHORITY & BRANCH REGISTRATION RENEWAL

 

**NO RENEWALS ARE ABLE TO BE SUBMITTED ONLINE AT THIS TIME**

The renewal period begins on July 1st and runs through September 1st of each year. All renewal applications and fees must be submitted to the Board office by September 1st of each year.  Renewal applications and fees may be submitted to the Board office September 2nd through October 1st with an accompanying late fee of $100. If no renewal application is submitted during the renewal period or late period, the Certificate Holder will be in default and must cease all preneed sales. ANY PRENEED SALES WITHOUT A VALID CERTIFICATE OF AUTHORITY OR PRENEED SALES AGENT REGISTRATION IS A VIOLATION OF ALA. CODE § 34-13-203(a)(1) AND MAY SUBJECT THE VIOLATOR(S) TO CRIMINAL ACTION.

Beginning September 2nd, if a Certificate Holder has not successfully submitted an online renewal application, the $100 late fee will automatically be applied. The fine must be paid during the renewal application submission process. If a Certificate Holder’s renewal application, including payment of renewal fees and fines, has not been submitted before October 1st, then the Certificate of Authority will expire, resulting in the termination of any related Branch Registrations and Preneed Sales Agent Registrations. Preneed sales may not resume until a new Certificate of Authority application, new Branch Registrations, new Preneed Sales Agent Registrations, all supporting documentation/checklists, related fees and $100 late fee have been submitted to the Board and approved.

***Financial Statements Requirement: The Certificate Holder will submit the key financial numbers from its financial statements covering its fiscal year most recently ended. Certificate Holders will be required to submit formal and separate financial statements to the Board. They may be submitted with renewal application.  Failure to submit formal and separate financial statements will result in a $50 per day fine until the financial statement is received by the Board.  If a Certificate Holder’s financial statement has not been submitted by September 1st, the $50 per day fine will automatically begin to accrue.  Fines are currently capped at $3000 ($50 per day for 60 days).  If the Certificate Holder’s financial statements are not received by October 31st, then the Certificate of Authority will be in default and expire, resulting in the termination of any related Branch Registrations and Preneed Sales Agent Registrations.  Preneed sales may not resume until a new Certificate of Authority application, Branch Registrations, new Preneed Sales Agent Registrations, all supporting documentation/checklists, related fees, and the $3000 late fine have been submitted to the Board and approved.

The key financial numbers should be calculated in the same manner as required in prior years. The only change is the form, which has eliminated all, but specific figures related to preneed and certain totals which will come from the certificate holders complete financial statements.
